Terms of Use

These Terms govern your use of the websites that link to these Terms. These Terms are a binding agreement between our Clients (each, a “Client” or “you”) and Interstate Title Solutions, LLC, (“ITS Nationwide”), a branded product of Interstate Title Solutions, LLC (“we” or “our”).

In these Terms, the word “Sites” refers to each of these websites and the services offered on those Sites. You automatically agree to these Terms and to our Privacy Policy simply by using or logging into the Sites.

Client’s use of ITS Nationwide products and/or services are provided by ITS Nationwide pursuant to a separate manually or digitally executed agreement and ITS Nationwide’s Terms and Conditions located at https://www.itsnationwide.com/terms-and-conditions/ (“Terms and Conditions”). Those additional terms, including the Terms and Conditions, are part of Client’s agreement with ITS Nationwide, if Client uses ITS Nationwide’s services and/or products or logs into the Sites, and shall govern any and all transactions and services between you and ITS Nationwide. The Terms and Conditions are incorporated by reference into these Terms by reference thereto.

A. Your Accounts
Client may be required to create an account and specify a password to access certain services or features on the Sites.
To create an account, Client must speak with an ITS Nationwide representative to obtain and submit the appropriate account setup documentation, and if Client does so, we expect that the Client’s agent(s) is at least 18 years old and has provided truthful and accurate information about themselves. If Client’s or Client’s agent’s information changes at any time, you must update the account directly or notify an ITS Nationwide representative so that the account may reflect those changes.

In some cases, an account may be assigned to a Client’s agent by an account administrator. If Client’s agent is using or logging into an account assigned by an administrator, additional terms may apply to the use of the Sites. Client’s administrator may be able to access or disable Client agent’s account without ITS Nationwide’s involvement.

Client or Client’s agent(s) may not share an account with anyone else. Client or Client’s agent(s) must keep associated password confidential and it is advised to not use the same password on other websites. If Client or a Client’s agent believe an account has been compromised at any time, a notification must be made to the Client’s system administrator, and the Client’s administrator is required to notify ITS Nationwide immediately.

B. Modifications and Termination
We reserve the right to modify our Sites at any time, with or without notice to Client. ITS Nationwide may add or remove functionality or features and may suspend or stop a particular feature altogether. We reserve the right to charge a fee for any of our features at any time. If Client does not agree with made changes, Client and Client’s agent(s) can stop using Sites at any time.

C. Content You Post
We may provide opportunities for Client to post text, photographs, videos, or other content (collectively, “Content”) on the Sites. Client can only post Content if Client owns all the rights to that Content, or if another rights holder has given Client permission.

Client does not transfer ownership of Client’s Content simply by posting it. However, by posting Content, Client grants ITS Nationwide, our agents, licensees, and assigns an irrevocable, perpetual (non-exclusive) right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use Client’s Content. Without previously listed rights, ITS Nationwide’s Services cannot be offered. License for posted Content continues even if Client stops using Sites.

Client agrees to indemnify, release, and hold ITS Nationwide harmless from any all liability, claims, actions, loss, harm, damage, injury, cost, or expense arising out of any Content Client posts.

If Client sends ITS Nationwide any information, ideas, suggestions, or other communications, those communications will not be confidential. Unless we tell Client otherwise, we reserve the right to reproduce, use, disclose, and distribute such communications without any obligation to Client.

D. Content Posted by Others
We are not responsible for, and do not endorse, Content posted by any other person. Accordingly, we may not be held liable, directly, or indirectly, for any loss or damage caused to Client in connection with any Content posted by another member.

E. Your Use of the Sites
Sites cannot be used in a way that violates any laws, infringes on anyone’s rights, is offensive, or interferes with the Sites or any features on the Sites (including any technological measures we employ to enforce these Terms). If we (in our sole discretion) determine that Client has acted inappropriately, we reserve the right to take down Content, terminate Client’s account, prohibit you from using the Sites, and take appropriate legal action.

Using ITS Nationwide’s Sites does not give Client ownership of any intellectual property rights to the content Client accesses. Client may not use content from our Sites unless Client obtains permission from ITS Nationwide or its owner, or unless Client is otherwise permitted by law.

When Client uses a Sites or sends communications to ITS Nationwide through Sites, Client is communicating with ITS Nationwide electronically. Client consent to receive any communications electronically related to Client’s use of Sites. We may communicate with Client by email or by posting notices on the Sites. Client agrees that all agreements, notices, disclosures, and other communications that are provided to Client’s electronically satisfy any legal requirement that such communications be in writing. All notices from ITS Nationwide intended for receipt by Client shall be deemed delivered and effective when sent to the email address Client provided to ITS Nationwide.

By submitting Content, creating a user account, or otherwise providing ITS Nationwide with Client email address, postal address or phone number, Client is agreeing that we or our agents may contact Client at that address or number in a manner consistent with ITS Nationwide’s Privacy Policy.

F. Intellectual Property
If Client believes any Content on the Services infringes Client’s copyrights, Client may request removal of Content from the Services (or disable access to that Content) by contacting ITS Nationwide via email at [email protected].

G. Social Networks
The Service may include features that operate in conjunction with certain third party social networking websites that Client visits such as Facebook, Instagram, YouTube, LinkedIn, Vimeo, and Twitter (“Social Network Features”). While Client’s use of the Social Network Features is governed by these Terms, Client’s access and use of third party social networking sites and the services provided through the Services is governed by the terms of service and other agreements posted on these sites. Client is responsible for ensuring that Client’s use of those sites complies with any applicable terms of service or other agreements.

H. Our Warranties and Disclaimers
We provide our Services using a commercially reasonable level of care and promise to do our best to make sure you enjoy the Services. There are certain things that we don’t promise about our Services.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OF SERVICE, NEITHER ITSNATIONWIDE.COM, NOR ITS AGENTS OR SERVICE PROVIDERS (THE “SERVICES ENTITIES”) MAKE ANY SPECIFIC PROMISES ABOUT THE SITES. FOR EXAMPLE, WE DO NOT MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SITES, THE SPECIFIC FUNCTION OF THE SITES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET CLIENT’S NEEDS. WE PROVIDE THE SITES “AS IS.” SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.

I. Liability for our Services
EXCEPT WHERE PROHIBITED, THE SERVICES ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM CLIENT’S USE OF THE SITES OR ANY THIRD PARTY’S USE OF THE SITES. THESE EXCLUSIONS INCLUDE, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST DATA, COMPUTER FAILURE, OR THE VIOLATION OF CLIENT’S RIGHTS BY ANY THIRD PARTY, EVEN IF THE SERVICES ENTITIES HAVE BEEN ADVISED OF THE POSSIBILITY THEREOF AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY UPON WHICH THE CLAIM IS BASED.

J. Additional Details
We may modify these Terms at any time so be sure to check back regularly. By continuing to use or log into Sites after these Terms have changed, Client indicates Client’s agreement to the revised Terms. If Client does not agree to the changes, Client should stop using or logging in to the Sites.

The Sites may contain links to third party websites. ITS Nationwide does not control or endorse those websites, or any goods or services sold on those websites. Similarly, the Sites may contain ads from third parties. We do not control or endorse any products being advertised.

If Client does not comply with these Terms, and we don’t take action right away, this does not mean we accept the Client’s non-compliance, nor does it mean we are giving up any rights that we may have (such as taking action in the future).

These Terms are governed by and construed in accordance with the laws of Florida, without regard to its conflict of laws rules. Client expressly agrees that the exclusive jurisdiction for any claim or dispute under these Terms and or Client’s use of the Services resides in the courts located in West Palm Beach, Florida, and Client further expressly agree to submit to the personal jurisdiction of such courts for the purpose of litigating any such claim or action. If it turns out that a particular provision in these Terms is not enforceable, that will not affect any other provision.

ITS Nationwide accepts and responds to any requests such as disclosure, correction, addition, or deletion and veto of use or provision of personal information (the “Disclosure Requests”) from the person who provided his/her/they personal information.
